Terms of Service

1. Acceptance of Terms

By creating an account or using the Tinwise mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you represent that your parent or guardian has reviewed and agreed to these Terms.

3. Account Registration

You must register an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to update it as necessary. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or remain inactive for an extended period.

4. Permitted Use

The App is designed for personal, non-commercial use to:

You may not use the App for any unlawful purpose, to harass other users, to distribute spam or malware, to scrape or bulk-download data, or to interfere with the App's operation.

5. User-Generated Content

5.1 Your Content

You retain ownership of content you create in the App, including reviews, photos, cellar notes, and price reports ("Your Content"). By posting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and store Your Content as necessary to operate the App and provide its features to you and other users.

Tinwise maintains a zero-tolerance policy for objectionable content and abusive behavior on our platform.

You agree that Your Content will not:

5.3 Content Moderation

We reserve the right, but are not obligated, to review, edit, or remove any user-generated content that violates these Terms or that we deem inappropriate in our sole discretion. We may do so without prior notice.

Users who post objectionable content or engage in abusive behavior will have their content immediately removed and their account permanently terminated. Repeat or severe violations may result in permanent bans without prior warning.

We commit to reviewing and acting on all user-submitted content reports within 24 hours of receipt. This includes removing objectionable content and taking appropriate action against the offending account.

5.4 Blocking

You may block any user at any time through their profile. Blocking a user will immediately remove all of their content from your feed and prevent any further interaction between your accounts. When you block a user, our moderation team is automatically notified and will review the blocked user's account and content for potential violations.

6. Community Catalog Data

Sardine product information contributed to the community catalog becomes part of the shared database. While you may delete your personal account and all associated personal data, product catalog contributions may be retained as community data, disassociated from your identity.

7. AI Features

The App includes AI-powered features provided through Anthropic's Claude API. Review photos and text content are automatically screened by AI before publication. Data sent to AI services is processed solely to provide the requested feature and is not used to train AI models.

These features are provided "as is" and may produce inaccurate results. AI-generated recommendations are not food safety advice. Do not rely on AI aging predictions to determine whether food is safe to consume.

8. Health Metrics Disclaimer

The App provides health-related features including omega-3 intake tracking, nutrition logging, health scores, consumption streaks, achievement milestones, timed sardine challenges, badge rewards, and Taste Passport award stamps. These features are for informational and entertainment purposes only.

Always consult a qualified healthcare provider before making dietary decisions based on information displayed in the App.

9. Push Notifications

With your permission, the App may send push notifications for features you have opted into. You can manage notification preferences within the App's settings or disable notifications entirely through your device's system settings.

10. Intellectual Property

The App, its design, code, logos, and non-user-generated content are owned by us and protected by intellectual property laws. "Tinwise" and the Tinwise logo are our trademarks.

11. Account Deletion

You may delete your account at any time through the App's settings. Upon deletion, we will permanently remove all your personal data within 30 days. Some anonymized or aggregated data (such as product catalog contributions) may be retained as described in Section 6.

12. Disclaimers

We do not guarantee the accuracy of nutritional data, health scores, omega-3 estimates, product information, or AI-generated content. We do not guarantee uninterrupted or error-free operation of the App.

13. Limitation of Liability

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia. Any dispute shall be resolved by the Harju County Court (Harju Maakohus) in Tallinn, Estonia, unless mandatory consumer protection laws in your jurisdiction require otherwise.

If you are a consumer in the European Union, you retain any mandatory rights granted under the consumer protection laws of your country of residence.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
